Man Who Sexually Assaulted Eight-Year-Old Cousin At Kildare Address Fails To Have One-Year Jail Time Reduced On Appeal

A 41-year-old man who sexually abused his eight-year-old cousin whilst babysitting her over two decades ago has failed to have his one-year jail term reduced on appeal.

According to The Irish Independent, the man pleaded guilty to one count of sexual assault at an address in Kildare in the summer of 1999.

He cannot be named to protect the anonymity of the victim.

Outlined by an investigating garda, the man was 15-years-old at the time of his offence, while the victim was eight-years-old.

Four incidents of sexual assault occurred in the injured party's family home where the then-teenager was staying for the summer.

In her victim impact statement, the woman stated that the while the offender actively participated in family events and was "celebrated", she had lived with shame and guilt.

Judge Martin Nolan of sentenced the man to three years with the final two suspended on strict conditions at Dublin Circuit Criminal Court on March 26, 2025.

Today at the Court of Appeal, Mr Justice John Edwards said he was satisfied with the ultimate sentence, denying the man of having his jail time reduced on appeal.

It was noted that the offence took place 25 years previously, and the court believed the judge acted accordingly when sentencing the man for offences he committed when he was 15.

The Irish Independent states that the court was said to be satisfied with the sentencing judge's appropriate consideration to the man's plea of guilty, as well as his lack of previous offending, good work record and his family responsibilities.

It was said by the judge that appropriate allowances were also made for the man's youth and immaturity at the time of offending.

Also in her victim impact statement, the woman said the abuse from the man "changed the trajectory of [her] life".
