A Kildare community group can proceed with a legal challenge to planning permission granted to 333 homes, following a High Court decision.
Last week, Kfm Radio reported, Clane Community Council was granted leave to challenge An Bord Pleanala Strategic Housing Development permission for for 142 homes on the western side of Millicent Road and southern side of Prosperous Road.
Developers proposing more than 100 homes do not have to engage with local planning authorities, and can submit their application to ABP.
The community council feels the granting of this permission, in the context of granting leave for another large housing development in the same area, amounts to over-development
The Irish Times reports this afternoon that Clane Community Council has secured permission to challenge approval for a separate developmenmt of 333 homes, granted permission by ABP on April 13th,
The publication reports "On the application of Stephen Dodd SC, instructed by F.P. Logue Solicitors, for the group, the judge granted a stay, subject to liberty to apply, restraining works under the permission.
The group wanted a stay because some 1.6 hectares of woodland was felled in advance of the planning application for the site, known as the KDA1 site, and it is concerned more woodland may be cleared with potential impact on bats and other species, counsel said."
In both cases, which will proceed independently of one another, the CCC contends, among other claims, that the permissions amount to over-development"
The Irish Times reports, of the challenge against the permission for 333 home, "The core grounds of challenge include claims that the development is in material contravention of the settlement policy and housing allocation relating to Clane in the Kildare county development plan 2017-2023 and Clane Local Area Plan."
